Louisiana's hemp laws have changed significantly over the past few years. Products that were once easy to find at convenience stores, smoke shops, and specialty retailers are now subject to much stricter regulations. These changes have affected both businesses and consumers, and lawmakers continue to discuss what the future of hemp should look like in the state.

As Louisiana's hemp laws continue to change, many residents are looking more closely at the state's medical marijuana program as a reliable way to legally access regulated marijuana products.

What Is the Difference Between Hemp & Marijuana?

Hemp and marijuana both come from the cannabis plant family, but they are regulated differently and have important differences.

Hemp refers to varieties of the plant that contain very low levels of THC, the compound responsible for the intoxicating effects commonly associated with marijuana. Under federal law, hemp is defined as containing no more than 0.3% THC by dry weight.

Marijuana, on the other hand, refers to varieties of the plant that contain higher levels of THC and are used for medical or recreational purposes in states where they are legal, including Louisiana's medical marijuana program. Because marijuana products contain more THC, they are regulated more strictly than hemp products. The higher and more consistent levels of THC found in medical marijuana products can also produce stronger and more predictable effects, which is why many patients choose regulated medical marijuana when seeking potential relief for certain symptoms and conditions.

Hemp-derived products and medical marijuana products are regulated differently and can vary greatly in their THC content and effects. How Louisiana's Hemp Laws Have Changed

Act 752 (House Bill 952), which took effect on January 1, 2025, significantly changed Louisiana's hemp industry. The law introduced new restrictions on hemp products, including limits on what can be sold, where products can be sold, and who can legally purchase them. 

These restrictions apply specifically to hemp-derived consumable products and do not apply to medical marijuana products purchased through licensed dispensaries. Under Act No. 752, hemp products available outside of the medical marijuana system face new limits, including:

• Edible hemp product limits: Hemp-derived edible products are limited to 5 mg of total THC per serving and 40 mg of total THC per package. Comparatively, medical marijuana products available through Louisiana dispensaries are not subject to the same 5 mg THC per serving limit as hemp products and can contain higher, more consistent levels of THC.

• Hemp beverage restrictions: Hemp-derived beverages are limited to 5 mg of THC per serving, must be sold in containers of at least 12 ounces, and are limited to four containers per package.

• Inhalable hemp product ban: The law prohibits the retail sale, production, and distribution of inhalable hemp products, including THCA flower, prerolls, and hemp-derived vapes.

• Alcohol restrictions: Businesses cannot add consumable hemp components directly into alcoholic beverages.

• Age requirements: Consumers must be at least 21 years old to purchase legal hemp-derived consumable products.

While these restrictions affect hemp products sold outside of Louisiana's medical marijuana program, they do not impact approved patients who receive medical marijuana through licensed dispensaries. The state's medical marijuana program continues to operate separately, providing eligible patients with access to regulated marijuana products recommended by a licensed marijuana doctor.

What's Next for Louisiana Hemp?

Although the current hemp regulations are in effect, discussions about additional changes are likely to continue.

During the 2026 legislative session, House Bill 539 was introduced to expand where certain consumable hemp products could be purchased, including allowing some bars and restaurants to sell approved hemp products. However, the proposal was ultimately withdrawn, leaving the current hemp regulations in place.

As hemp products continue to grow in popularity across the country, Louisiana lawmakers may introduce additional legislation in future sessions. Some proposals could further restrict hemp products, while others may expand opportunities for businesses. For now, consumers should expect the current regulations to remain in effect unless new legislation is passed.

Who Can Qualify for Medical Marijuana?

One reason Louisiana's medical marijuana program has continued to grow is its flexible eligibility requirements.

Unlike many other states, Louisiana does not have a limited list of qualifying medical conditions. Instead, state law allows a licensed marijuana doctor to recommend medical marijuana for any condition they believe may benefit from marijuana treatment. That means any medical condition can qualify for medical marijuana.

The process for joining Louisiana's medical marijuana program is straightforward.
