Louisiana lawmakers are moving forward with a new bill that would allow terminally ill patients to use medical marijuana while receiving care in hospitals. SB 270 has already passed the state Senate and is now being considered in the House. If approved, it would create new protections for patients who rely on marijuana to manage serious symptoms during end-of-life care.

This change is focused on giving patients more comfort and control during some of the most difficult stages of illness.

What the Bill Would Change

Right now, hospitals in Louisiana do not allow patients to use medical marijuana while admitted, even if they are legally registered in the state program. The new bill would change that for a specific group of patients.

If passed, the law would allow terminally ill patients with a valid medical marijuana recommendation to continue using their medication during hospital stays. The goal is to make sure patients do not lose access to treatments that help them feel more comfortable during serious medical care.

The bill is limited to patients who have a terminal and irreversible condition, meaning their illness is expected to significantly shorten their life expectancy.

Why This Matters for Patients

Many patients with terminal conditions already use medical marijuana to help manage symptoms such as:

For these patients, consistency in treatment can make a major difference in quality of life. Without SB 270, patients often have to stop using medical marijuana once they are admitted to a hospital, even if it has been helping them at home.

Supporters of the bill say this can lead to unnecessary discomfort during an already difficult time. Allowing continued use could help patients stay more comfortable and stable while receiving hospital care.

How Medical Marijuana Would Be Allowed in Hospitals

The bill includes strict guidelines to ensure patient safety and hospital oversight.

Under the proposal:

  • Smoking or vaping marijuana would not be allowed in hospitals

  • Patients could use approved forms such as oils, tinctures, capsules, or edibles

  • Patients or their caregivers would be responsible for handling and administering the medicine

  • Medical marijuana would need to be stored securely when not in use

  • Hospitals would be required to develop internal policies for how it is managed

These rules are designed to balance patient access with hospital safety requirements and medical supervision.

Important Limits in the Bill

While SB 270 expands access, it also includes clear restrictions.

It would only apply to:

It would not apply to:

  • Emergency room visits

  • Outpatient services

  • Patients without terminal conditions

In addition, hospital staff would not be allowed to provide, handle, or administer medical marijuana directly. The responsibility would remain with the patient or their caregiver.

What This Means for Louisiana’s Medical Marijuana Program

Louisiana already has an established medical marijuana program, but it works differently from many other states. Instead of a strict list of qualifying conditions, physicians in Louisiana can recommend medical marijuana for any condition they believe could benefit from therapeutic marijuana use as a treatment option.

This gives doctors more flexibility to decide what is appropriate based on a patient’s individual health needs.

However, even with this flexible system, access has still been limited in hospital settings. Hospitals do not currently allow patients to use medical marijuana while admitted, even if it has been recommended by their physician.

SB 270 aims to change that for terminally ill patients, helping ensure they can continue their treatment during hospital stays when comfort and symptom relief are most important.

Looking Ahead

SB 270 has cleared the Louisiana Senate and now awaits consideration in the House of Representatives. If it passes both chambers and is signed into law, it would take effect this year.

For patients and families, the proposal represents a meaningful change in end-of-life care. It focuses on comfort, dignity, and allowing patients to continue treatments that help them manage symptoms during some of life’s most challenging moments.

Louisiana’s medical marijuana program continues to evolve, and this legislation shows a growing focus on patient-centered care, especially for those who need it most.
